The fees paid for conducting the trademark search and preparing the registration application are non-refundable, even if the United States Patent and Trademark Office (USPTO) ultimately rejects your application.

There are no refunds if the trademark does not register, including any fees paid to the USPTO or for legal services, regardless of the outcome.

The quoted fee does not include the USPTO filing fee.

If you wish to apply for additional marks (e.g., both a standard word mark and a logo mark in the same class), or for additional classes (e.g. class 25 for apparel and class 14 for jewelry), you will be responsible for paying additional USPTO fees of $350 per class, subject to the USPTO’s fee schedule at the time of filing.

If your application receives a substantive Office Action, the response is not included in the flat fee. A separate rate will be offered for handling that response.

For “intent to use” applications, an additional flat fee will apply for filing the required Statement of Use, which is also not included in the initial application fee.

You may choose to pay the flat fee in installments; however, you acknowledge that the longer it takes to complete payment, the more likely it is that the search results will become stale or outdated, as they are time-sensitive.

The attorney is not obligated to conduct updated or additional searches if significant time passes before the payment is completed.
